Terms and Conditions

The Terms and Conditions of Use (the Terms) are a binding contract between you and Artisense Online Sdn Bhd (AO, We and Us).

Using our services means that you agree to all the Terms, and the Terms will remain in effect while you use the Services.

Will the Terms ever change?

As we may review @card Services (the Services), so the Terms may change along with the Services.

We may update the Terms from time to time (please check this page periodically). Posted changes in the Privacy Policy takes immediate effect.

If you use the Services in any way after a change to the Terms is effected, that means you agree to all the changes.

User’s Privacy

We will observe the privacy of our users. For AO’s Privacy Policy, please refer below.

Fundamentals

We enable users to create a personal @card to provide information about who you are, what you do, your portfolio, and others.

When you sign up for an account, kindly provide your:

1. Email address

2. Password

You promise to provide us with accurate and updated registration information about yourself.

You may not transfer your account to anyone else without any written permission.

The Account is not shared with anyone.

If your use of services prohibited by laws, we are not responsible for your use of the Services in a way that breaks the law.

Security of your account and your password are your responsibilities, so are activities associated with your account.

As an @card user, you warrant and agree that you will not contribute or lead to:

1. Infringement of intellectual property rights (including AO)

2. Displays that are among others harmful, harasses, defames, fraudulent and obscene.

3. Attempts, in any manner, to break into the password, account or other security information from any other user;

4. Violates security to crack any passwords or security encryption codes;

5. Risks security of your @card account by allowing someone else to log into the Services as you

6. Runs any processes that activate while you are not logged into the Services

7. Interrupts the proper working of the Services (including placing unreasonable load on the Services);

8. Crawl, spider or autobot any page, data and parts thereof relating to the Services or Content (through manual or automated means)

9. Decompile, reverse, rearrange, disassemble, decrypt or otherwise extract among others source codes and databases relating to the Services.

What are my @card rights?

Materials displayed or used throughout the Services, including, but not limited to, data, text, graphics, visuals and photos.

You have a right to give feedbacks. You will be entitled to 3 (three) amendments to the card within 3 (three) working days after we send you the product. (exception for Wedding E-invitation @card)

Sharing and distribution of your @card for networking purposes as deemed fit by you.

To ask for assistance for issues involving @card services as and when they may arise.

The right to grant third party access by informing in writing to us that this access is allowed by you for specific reasons.

Do I have to grant any rights to AO or to other users?

Your materials and resources submitted to us for the Services automatically grant us the rights to adapt, display, translate, or use them in any way (with reference to the Privacy Policy) in order to avail you of the Services.

If you provide us with any feedbacks relating to the Services, then you grant us the rights to use, and otherwise exploit the Feedback for any purpose.

Awareness of Responsibilities in the Services

AO assumes no responsibility for your interaction with your audiences. It’s up to you to share, distribute or transmit.

You are responsible for all Content you contributed, in any manner to the Services and you warrant you have all rights necessary to do so in the manner in which you have contributed them.

You are aware of compliance to policies, views and practices in any third party @card Services you interact with through the Services.

Third party @card Services in the Services may hold links or connections not owned or controlled by AO. As such, you agree to hold AO harmless against any risks or damages associated with the aforesaid.

Should dispute with one or more other audiences arise, you agree to hold harmless us, our management, staff and representatives from damages of every possibility in any way related to such disputes in the provision of the Services.

Use of @card Services Rules

Rules of @card being as follows:

A yearly fee of RM30 subscription per card (free one-time content update) that is renewable upon 12 months.

You will be entitled to 3 (three) amendments to the card within 3 (three) working days after we send you the product. After 3 (three) amendments, you will be subject to RM50 per amendment per card.

The photos in every @card are only for display purposes, it will not be included in the product.

You may pay directly when placing order on our website using online banking or credit card payment method. No invoice provided.

The processing of payments will be subject to the terms, conditions and privacy policies of the payment processor in addition to the Terms.

If we, through the payment processor do not receive payment from you, you agree to pay all amounts due upon AO’s request.

You will promptly update all information to keep your billing account updated and accurate. You must promptly notify us or our payment processor if your payment did not go through.

You take precautions for security including unauthorized disclosure or use of your username or password. Changes to such information can be made in your account settings.

You agree that we may assume that you wish to continue use of our @card Services under your billing account unless you terminated your account.

In order to use your @card, you need to pay the yearly subscription fees.

Terminating @card Services

First year of subscription is free. You will be reminded one month before the expiry date, whereby you will pay RM30 for the following year’s annual subscription including a one-time INFO update service.

If you did not extend the yearly subscription, we would assume that you would no longer be interested to continue with the subscription and we will terminate the card.

A user can terminate his @card Services at anyone time by deleting his account, AO is also free to terminate (or temporarily suspend) your use of Services for any breach of the Terms.

The following will apply after termination including obligation to indemnify us, unsettled payment(s) and any terms of ownership, intellectual property rights and any disputes between us.

You will be responsible for paying and filing of all dutiful taxes, duties and other government assessments associated with the Services.

Disclaimer

We, as rights holders and suppliers make no warranties or recommendations of services offered through the Services.

AO rights holders or suppliers do not warrant contents through the Services and will not be liable for copyright, accuracy, compliance or resources accessed through the Services.

To the fullest extent allowed by the law, you agree to indemnify and hold AO, its affiliates, agents, employees and partners harmless from and against any form of all claims, liabilities, damages and expenses arising from or in any way in the provision of @card Services.

Assignment to Others

You will not assign or transfer the Terms or your rights or obligations hereunder, or your Services account, in any way (via the law or otherwise) without AO’s prior written consent. We may transfer or assign the Terms and our rights and obligations without consent.

Legals

By visiting @card or purchasing any services, you agree to submit to the jurisdiction of the legalities in Malaysia.

You and AO agree to this mutual understanding between you and AO and that it supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject of the Terms.

You hereby acknowledge you will not bind AO in any respect whatsoever.

Privacy Policy

We are committed to data privacy as shown from its existing safe and secure practices.

Information Collection and Usage

To enable a better experience, you are advised to provide us with personally identifiable information including but not restricted to your name, telephone number, email and company name. This information is used to identify and contact you.

Log Data

We want to inform you whenever you visit the Service, we will collect information that your browser sends to us called Log Data. This Log Data may include information e.g., your computer IP address, browser version, pages of our service that you visit, time and date of your visit, time spent on those pages and other statistics., browser version, pages of our service you visited, visit time and date, time spent on those pages and other statistics.

Cookies

Cookies are files with small amount of data that is used as an anonymous unique identifier. They are sent to your browser from the website you visit and are stored on your computer’s hard drive. Our website uses these “cookies” to collect information and to improve the Service. You can either accept or refuse these cookies and know when a cookie is being sent to your computer. If you choose to refuse our cookies, you may not be able to use certain portions of the Service.

By virtue of the privacy policy, we will keep all data protected as far as possible. It is not our policy to disclose any of your information to parties not involved with the Service.

The data from you will be used to communicate in order to upkeep @card maintenance. The data will be used to prevent and solve technical issues.

The data will be used to provide customer support. The data will be used to track use of the Service. The data will be used to obtain information, so we can improve the Service to you.

The data may be used to transfer data across computers located on other jurisdictions however with the standards of online security intact including but not limited to payment processing.
